California Laws Under Which Employers May be Found Liable


Agricultural Labor Relations Act

(Prohibit discharge for exercising rights of agricultural workers to organize and engage in other protected, concerted activity.)


Arrest Records

(Most employers are prohibited from inquiring into arrest records that did not lead to convictions, or making employment decisions based on those records.)


Consumer Credit Reporting Acencies Act

(Employer requesting a report for a credit reporting agency must disclose to the applicnt that the request is being made)


Drug and Alcohol Rehabilitation Act

(Private employers with more than 25 employees must reasonably accommodate an employee who participates in an alcohol or drug rehabilitation program.)


Election Officers' Employment Protection

(An employer may not terminate someone's employment for serving as an election officer on election day.)


Fair Employment and Housing Act

(Prohibits employment discrimination based on race, religion, creed, color, national origin, ancestry, physical or mental disability, medical condition, marital status, age (over 40), pregnancy, childbirth or related medical conditions, or sex. Under this law employers have an independent duty to maintain a workplace free of harassment.)


Family Rights Leave Act

(Employers of 50 or more employees must permit up to 12 weeks per 12 month period of unpaid leave in connection with the employee's own serious health condition, birth, adoption or foster placement of a child, or for the medical care of certain relatives.)


Jury Service

(Prohibits discharge of employee for fulfilling jury service duties, discrimination or discharge for appearing in court as a witness as required by law.)


Military Service

(Prohibits discharge for participating in military service.)


Occupational Health and Safety

(Retaliation against employee for complaining of safety and health issues is prohibited.)


Participation in Labor Commission Proceedings

(Employee may not be discharged for participating in proceedings before the California Labor Commission.)


Political Activity

(Discharge for participating in political activity is prohibited.)


Polygraphs

(Termination of or retaliation against an employee in the private sector who refused to submit to a polygraph, lie detector, or similar test, is prohibited.)


Pregnancy Disability Leave

(Provides as much as four months of unpaid leave to an employee who is disabled due to pregnancy, childbirth, or related medical conditions.)


Sexual Orientation

(Discrimination against an employee on the basis of actual or perceived sexual orientation is prohibited.)


Time Off to Appear in School

(A parent or guardian taking time off to appear in school at the school's formal request man not be discharged or discriminated against for appearing.)


Volunteer Firefighters

(Volunteer firefighters may not be discharged or discriminated against for taking time off to perform emergency duties.)


Wage Garnishment

(Prohibits discharge on account of a wage garnishment related to a single instance of indebtedness.)


Wearing Pants

(Prohibits employer to refuse to permit employee to wear pants on account of the sex of the employee.)


Whistleblower Protection

(Employers may not discharge an employee or take any adverse action against an employee based on disclosure by the employee to any governmental or law enforcement agency of information regarding violation of federal or state law.)


Workers' Compensation Proceedings

(Employers may not discriminate or retaliate against any worker who has been injured in the course and scope of employment and pursued a claim for workers' compensation benefits.)
